1. Disclaimer and Limitation of Liability

Access to and use of Kani Travel’s website and services are at your own risk. All content, services, and materials on our website are provided “as is” and “as available,” without warranties or representations of any kind, express or implied. Kani Travel makes no warranties regarding merchantability, fitness for a particular purpose, accuracy, completeness, or reliability.

We do not guarantee that the website or any services will be uninterrupted, error-free, or completely secure. Users must ensure they have appropriate hardware, software, and internet services to access the website. While we take security seriously, the internet is not an inherently secure medium, and Kani Travel is not liable for any breaches of confidentiality, data interception, or misuse.

In no event shall Kani Travel, its affiliates, partners, agents, or providers be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from the use of or inability to access our website or services—including, but not limited to, loss of data, business interruption, or lost profits.

2. Force Majeure & Uncontrollable Circumstances

Kani Travel shall not be held responsible for delays, cancellations, or losses arising from events beyond its reasonable control, including but not limited to:

  • Natural disasters (earthquakes, floods, storms)
  • Political unrest, war, or acts of terrorism
  • Epidemics, pandemics, or health-related emergencies
  • Governmental regulations or travel restrictions
  • Strikes or labor disputes
  • Airline, hotel, or transportation disruptions

Any costs incurred due to such events—including additional accommodation, meals, transportation, or loss of enjoyment—are the traveler’s responsibility.

3. Responsibility and Conduct of Travelers

Kani Travel reserves the right to refuse service or remove any participant from a tour whose behavior is disruptive, unlawful, or poses a risk to others. No refund will be given for unused services or early departure due to misconduct.

Travelers must:

  • Abide by the laws of countries visited
  • Ensure they have valid travel documents (passport, visas, permits)
  • Assume responsibility for lost items, missed departures, or denied entry due to documentation issues

No refund will be issued for failure to complete the tour for personal reasons, including missed connections, late arrivals, or voluntary early departure.

4. Modifications, Cancellation, and Refunds

A. By Kani Travel

We reserve the right to cancel or adjust any itinerary due to weather, safety concerns, government regulations, or operational reasons. In such cases:

  • A full refund or alternative travel date will be offered for cancellations due to reasons not classified as force majeure
  • A future travel credit will be issued for force majeure-related interruptions

B. By the Traveler

Refer to our main Terms and Conditions for full details. Cancellations are subject to timelines and penalties as outlined for each product. No refunds will be issued for services voluntarily forfeited, missed, or unused.

5. Hotel, Transportation, and Third-Party Services

Kani Travel does not own or operate hotels, airlines, or local suppliers. We act solely as an agent between clients and service providers. As such:

  • We are not responsible for changes in service, quality, or performance by third parties
  • Hotel room types (double, triple, quad) are subject to availability and may vary (e.g., 2 double beds vs. 1 king)

All services are subject to the terms and conditions of the respective suppliers, and no independent arrangements (e.g., self-purchased tickets, third-party bookings) may be substituted during group travel.

6. Payment Terms

Payments made online or via credit card may require additional documentation for security verification. Kani Travel reserves the right to:

  • Request proof of identity, cardholder authorization, or other documents
  • Cancel any high-risk or suspicious transactions

Upon full payment, you will receive a confirmation voucher. If a product becomes unavailable after payment, a full refund will be issued within 7 business days.

7. Tour Inclusions and Exclusions

Inclusions:

  • Transport by luxury coach or flight as per itinerary
  • 4-star accommodation with private bath
  • Services of professional tour guide (English/Persian/French speaking upon request)
  • Listed sightseeing and admission fees (where noted)

Exclusions:

  • Meals not mentioned in itinerary
  • Tour guide and driver gratuities (suggested $16/day per person)
  • Personal expenses (phone, laundry, mini-bar, etc.)
  • Medical, travel, or baggage insurance
  • Costs incurred due to weather, delays, or force majeure
  • Any services not explicitly listed as "included"

8. Travel Insurance

Kani Travel strongly recommends purchasing travel insurance at the time of booking to protect against:

  • Trip cancellation or interruption
  • Medical emergencies abroad
  • Lost baggage or personal effects
  • Supplier default or unforeseen disruptions

Travelers are responsible for securing adequate insurance coverage. Kani Travel is not liable for any loss incurred due to a lack of insurance.

9. Photographic Release

By joining a Kani Travel tour, you consent to the use of photographs or videos taken during the trip for marketing and promotional purposes, without compensation.

10. Jurisdiction and Governing Law

These Terms are governed by the laws of Ontario, Canada, and any disputes shall be resolved in the courts of Toronto, Ontario. If any clause is found unenforceable, the remainder of the Terms will remain valid and enforceable.
